Employee Suit Allowed After Employer’s Internal Complaint Process Failed

Diana Ledbetter complained to a human resources representative, Gogel, about discrimination. Under her role as an HR representative, Gogel held responsibility for investigating and resolving those complaints. Gogel found, however, that her employer’s procedures prevented her from fulfilling that aspect of her job. She then referred Ledbetter to an attorney. Gogel’s employer allegedly fired her after learning of her activity. The Eleventh Circuit Court of Appeals found her actions “reasonable” because her employer’s procedures prevented her from resolving the complaints internally. https://www.lexology.com/library/detail.aspx?g=5f43f16b-7173-4607-8528-0ce6f1356d29&utm_source=lexology+daily+newsfeed&utm_medium=html+email+-+body+-+general+section&utm_campaign=lexology+subscriber+daily+feed&utm_content=lexology+daily+newsfeed+2018-11-07&utm_term=
