Employer “Busted” for Reducing Employees’ Hours to Avoid ACA Mandate

When Dave & Buster’s reduced hours for 1200 full-time employees in an attempt to avoid the ACA employer mandate, an employee filed a class action lawsuit in a federal district court in New York against Dave & Buster’s. Maria De Lourdes Parra Marin, the employee, claimed Dave & Buster’s violated ERISA by interfering with her right to attain benefits.
