Fifth Circuit Court of Appeals Settles Wrongful Termination Suit Against Major Airline Company

In October 2017, the district court presiding over western Texas ruled in favor of Southwest Airlines in a wrongful termination lawsuit brought by former employee, Tate Clark. Clark alleged the airline fired him for his absence due to chronic migraines despite the fact that he had FMLA in place because of his condition. However, Southwest contended that Clark was fired not because of his absences, but because of his remark to a fellow employee suggesting he wanted to buy a trench coat to wear to work in order to conceal a shotgun.
