Mississippi Construction Case Proves Valuable Lesson for Contractors

The Mississippi Court of Appeals was recently tasked with deciding if a check marked “final payment” allowed the project owner to be free and clear of further payments to a construction company though the amount of the check did not cover additional costs for the project. Though the construction company informed the owner they did not consider the project payment to be paid in full, the owner contended they were not obligated to pay any remaining balance due to the “final payment” marking on the check. Find out what the court decided here.
