State Court Claim No Longer Necessary for Takings Plaintiffs to File Federal Claim

In June, the United State’s Supreme Court overruled Williamson County Regional Planning Comm’n v. Hamilton Bank, 473 U.S. 172 (1985). Williamson County required takings plaintiffs to seek compensation under state law before they could bring a federal takings claim. Chief Justice Roberts wrote for the Court that “the state-litigation requirement imposes an unjustifiable burden on takings plaintiffs.” Learn more about the case here.
