Webb Sander & Williams Cases Cited in Mississippi Supreme Court Arguments

When the cases we were involved in are cited in arguments of other cases, it’s icing on the cake. Earlier this month two of our previous cases  Rhoden v. State Farm Fire & Casualty Co., 32 F. Supp. 2d 907, 913 (S.D. Miss. 1998) and Boteler v. State Farm, 876 So. 2d 1067 (Miss. Ct. App. 2004) were cited by the Mississippi Supreme Court in Mississippi Farm Bureau Casualty Insurance Company v. Dorothy Smith. Smith sued Farm Bureau after the insurance company denied her claim based on the earth-movement exclusion in the policy. Finding the exclusion in Farm Bureau’s policy to be most similar to those in Rhoden and Boteler, the Supreme Court reversed the trial court’s denial of Farm Bureau’s motion for summary judgment and rendered judgment in favor of Farm Bureau finding that the earth movement exclusion was unambiguous and excluded coverage for the damage suffered by Smith.  https://courts.ms.gov/Images/Opinions/CO136288.pdf
