Earlier this year, we covered the updated rules by the Center for Medicare and Medicaid Services that set consequences for non-CMS approved workers' compensation settlements. Employers, claimants, and their attorneys should be aware of these changes. A CMS contractor review remains voluntary, but employers and insurers who do not submit proposed settlements run the risk of a future lawsuit if they do not set aside enough funds to cover the cost of the claimant’s care.
