 DOL Withdraws Contractor Vs Employee Final Rule

The Department of Labor published a final rule in January 2021 drawing the line between employees and contractors. Four months later the organization repealed the rule. The now-defunct rule adopted the “economic reality” test which evaluated five factors to determine whether a worker was a contractor or employee. Prior to the publication of the final rule, federal courts across the country created their own tests to determine into which category a worker fell. With the withdrawal of the rule, employers are advised to seek legal guidance and follow the case law in their individual jurisdiction.
