Employee Claims Against Employers for Negligence in Hiring Fall Under Mississippi Worker’s Compensation Act

Darius Powell filed complaints against co-workers Rederick Kelly and O’Derrick Clark as well as the company for which they worked Schaffner Manufacturing Company, Inc. The circuit court dismissed the claims against Kelly and Clark because they were filed outside the statute of limitations. The court found Powell’s claims against Schaffner did not fall within the scope of the Mississippi Workers’ Compensation Act. On appeal, the Mississippi State Supreme Court disagreed. Claims against employers for negligence in hiring and supervision fall within the scope of the Mississippi Workers’ Compensation Act.
