In 2016, a Texas couple rented a home in Longboat Key, Florida through AirBnB. They later discovered videos of them recorded during their stay and alleged the homeowner had secretly recorded them. They sued AirBnB which filed a motion to compel arbitration. The case made its way to the state Supreme Court where justices found that AirBnB’s terms of service delegate arbitrability determinations to an arbitrator. This decision combined with a recent decision by the Florida Office of Insurance Regulation to approve a mandatory arbitration and mediation endorsement in homeowners' multi-peril policies may encourage more insurers to require arbitration clauses. https://www.claimsjournal.com/news/southeast/2022/04/05/309635.htm
