In 2016, a Texas couple rented a home in Longboat Key, Florida through AirBnB. They later discovered videos of them recorded during their stay and alleged the homeowner had secretly recorded them. They sued AirBnB which filed a motion to compel arbitration. The case made its way to the state Supreme Court where justices found that AirBnB’s terms of service delegate arbitrability determinations to an arbitrator.
