Lightning struck Louisiana State Senator Cleo Fields’s home in June 2016 causing more than $1 million in damage to the 16,000-square-foot structure. Fields filed a claim with his insurer QBE. The insurance adjuster inspected the home on three occasions before the company’s engineers delivered its report. QBE paid out $1,018,412 for covered losses and repairs. The company requested documentation of the work performed, but received few responses. A year after QBE paid out the claims, Fields filed suit and hired an engineer who estimated the damages at $1.6 million. The district court excluded the engineer’s report and granted summary judgment for QBE. The Fifth Circuit Court of Appeals affirmed that judgment. Keep reading to find out why.
