A contractors trade group, Restoration Association of Florida, filed suit against the state less than a week after Gov. Ron DeSantis signed SB 2-D. The law prevents contractors from recovering “prevailing party attorneys’ fees.” In some instances where homeowners need repairs quickly such as after a storm, the homeowners sign over their insurance claims to contractors in an “assignment of benefit.” The contractors then seek reimbursement for their work through the insurance benefits which often leads to lawsuits.
