Luv N’Care, Ltd. and Admar International, Inc. filed suit against Eastrock, LLC for copyright and trade infringement when Eastrock displayed copies of the Plaintiffs’ products on its website. The Plaintiffs filed suit in Louisiana although Eastrock has its principal place of business in Wisconsin. Eastrock moved to dismiss for lack of personal jurisdiction, and the district court granted the motion. The Plaintiffs appealed to the Fifth Circuit basing its jurisdiction claims primarily that the alleged infringing products contained in the Defendant’s posted content on its website was available worldwide. This, Eastrock claimed, established the ‘minimum contracts’ with the forum state required for personal jurisdiction. The Fifth Circuit (and its sister circuits) disagreed and affirmed the district court’s decision.
